Not to whoever used it first. Not to whoever owns it in the United States or in Europe. If your brand is not registered with IMPI, someone else can register it here — legally — and then charge you for the right to use your own name.

What foreign companies assume, and what actually applies

Almost every conversation we have about this starts from the same three assumptions. None of them holds in Mexico.

What applies here

Mexico grants the trademark to the first valid applicant. Prior use abroad, and even prior use inside Mexico, does not by itself beat a filing date.

Trademark rights are territorial. A US or European registration gives you nothing inside Mexico. It is a different register, a different office.

By the time you have sales, someone has noticed. Registering a name that is already selling here is a business, and the people who do it file faster than you will.

Registration together with the brand identity

A filing firm registers your trademark, but it does not design it. And in Mexico you normally file a marca mixta — the name and the logo together — so the design in the application is what gets protected for ten years. If you are going to need a logo anyway, doing both here takes MX$2,500 off whichever level you choose.

What the price covers

  • IVA included. The figures above are what you pay, not a pre-tax base. We invoice with a Mexican CFDI.
  • IMPI official fees for one Nice class. The government fee is inside the price, not billed on top of it afterwards.
  • Additional classes are quoted separately. If your company needs to protect more than one line of business, each extra class carries its own official fee. We tell you how many classes you actually need before you pay for any of them.
  • IMPI support programmes for small companies. IMPI periodically opens calls that reduce the official fees. There is not always one running and not every company qualifies, so we check it case by case during the consultation rather than promising it here.
  • No hourly billing. The package price is the price. Follow-up with IMPI over the six to eight months is part of it.

Why this is not the same as hiring a filing firm

Registering a trademark is a paperwork service almost anywhere. What is rare is getting it from the people who will also build the brand you are protecting.

  • The phonetic search is included, not an upsell. Knowing your name collides with an existing registration is worth more before you file than after.
  • IMPI official fees are inside the quoted price. Not everyone does this, and it is where surprise invoices usually come from.
  • We follow the file until there is a resolution, and tell you when IMPI raises an objection instead of waiting for you to ask.
  • Guidance on INDAUTOR, which protects the logo as an artistic work. It is a separate register from IMPI and it covers something different.
  • Logo and stationery from the same place, with a fixed discount when you combine them. Almost no filing firm can do this at all.

How the process works

Six steps. Everything is digital, so you can register a Mexican trademark from any state in the country — or from another country entirely.

You choose the package

Search only, registration, or registration with the brand identity built around it. If you are not sure, start with the search: five business days, MX$690, and credited back in full if you then register.

You send us the brand

The name, the logo if you already have one, and what you sell. That last part is what determines the Nice class, so it matters more than it sounds.

We review the documentation

We run the phonetic search, confirm the class, and write back with a viability report: whether the name is realistic, what it collides with, and what we would change.

We file with IMPI

The application is filed officially and you receive the IMPI receipt with your filing date. In a first-to-file country, that date is the thing you are actually buying.

We follow the file

Six to eight months of examination. If IMPI issues an official action, we tell you what it says and what we propose to answer, in English.

You receive the resolution

And, if it is granted, the registration title: ten years of exclusive use in Mexico, renewable.

Questions about registering in Mexico

Does our US or European trademark protect us in Mexico?

No. Trademark rights are territorial: a registration in the United States, Canada or the European Union has effect only where it was granted. Mexico is a separate register, run by IMPI. Mexico is also part of the Madrid Protocol, so if you already hold an international registration it is sometimes possible to extend it here instead — whether that is cheaper depends on how many countries you are covering. We will tell you which route makes sense for your case before you commit to either.

Do we need a Mexican company to own the trademark?

No. A foreign company or an individual can hold a Mexican trademark. What IMPI does require is an address in Mexico for official notifications, which is part of what we provide as your representative. If your structure is unusual — a holding company abroad, a local distributor, a joint venture — tell us during the consultation, because who is named as the owner is a decision that is expensive to change later.

What if someone has already registered our name here?

It happens, and it is exactly what the phonetic search is for: five business days and MX$690 to find out before you spend anything else — and that MX$690 comes back off the registration if you go ahead. If the name is taken there are usually routes — negotiating with the current holder, a cancellation action if they have not actually used the mark for three consecutive years, or filing a distinguishable version. Which of those is realistic depends on the case, and we say so plainly rather than selling you a filing that will be refused.

Why does it take six to eight months?

That is IMPI's examination time, not ours. The application is filed within days, and your filing date — the one that matters in a first-to-file country — is secured from that moment. What takes months is the formal and substantive examination, the publication period, and the resolution. Nobody can shorten it; anyone who says they can is describing the filing, not the grant.

What is a Nice class, and how many do we need?

The Nice Classification divides goods and services into 45 classes, and a trademark is protected only in the classes it is registered in. Most companies genuinely need one. Some need two or three because they both manufacture something and provide a service around it. The price above covers one class; each additional class carries its own IMPI fee. We work out how many you need from what you actually sell, not from how many we can bill.

What is INDAUTOR and why is it separate?

INDAUTOR is Mexico's copyright office. IMPI protects your trademark — the name and how it identifies you commercially. INDAUTOR protects the logo as an artistic work. They cover different things and neither replaces the other. For a foreign brand entering Mexico with a distinctive logo, having both is meaningfully stronger than having one, and it is included in the registration plus brand identity package.

Do we have to be in Mexico City for any of this?

No. The whole process is digital. We work with companies across Mexico and from abroad, and nothing about the registration requires a meeting, a physical signature in person, or a trip. Our offices are in Colonia Del Valle Sur in Mexico City if you want to come, but it is never a requirement.

Are the prices really in pesos, and can we pay from abroad?

Yes, prices are in Mexican pesos and include IVA, because the IMPI fees inside them are set in pesos. Quoting in dollars would mean adding a margin to absorb the exchange rate, and you would pay for that margin. Your written quote includes the dollar equivalent at that day's rate, and we invoice with a Mexican CFDI that your accounting department can process.
